On the 29th of August 2023, the NSPCA lodged criminal charges against Mr. Julius Malema under CAS 35/8/2023 for suspected animal cruelty. The incident was recorded in distressing footage that showed Mr. Malema behaving violently toward a fully conscious animal. The widely circulated video featured members of the Economic Freedom Fighters (EFF) political party participating in a “ceremonial slaughter” of animals as part of their 10th-anniversary celebration at a farm in Magaliesburg.
The troubling video evidence depicts Mr. Malema using two small knives to deliver over 11 stabs and more than 60 twisting motions to the animal’s head, which constitutes unnecessary suffering and extreme cruelty.
Since it was registered, the case has been transferred multiple times between various SAPS stations and ultimately to the State. Initially, the prosecutor decided not to proceed with the case; however, after further discussions, this decision was reinstated, although no clear explanation was provided for the reversal.
On the 15th of January 2024, we received notification from the Senior Public Prosecutor stating their decision to decline prosecution based on perceived inadequacies. The NSPCA expressed disbelief at this outcome and subsequently escalated the matter to the Director of Public Prosecutions (DPP) for further review. Following this, the case was examined by the DPP and referred to the Chief Prosecutor for further investigation.
Despite our continued efforts over the past year, the case has remained in a state of limbo between the State and SAPS, hindered by insufficient progress. To date, SAPS has not managed to obtain a warning statement from the accused. These ongoing delays not only impede the pursuit of justice but also jeopardize vital evidence, witness testimony, and accountability for the accused.
We find this situation unacceptable. The NSPCA remains unwavering in its commitment to advocate for animal welfare and is determined to assist the State in achieving justice for the affected animal.
As a statutory body established under the Societies for the Prevention of Cruelty to Animals Act 169 of 1993, the NSPCA is mandated to act in accordance with this legislation. We assure you that our office will not waver in our commitment to this mandate and will pursue this matter with vigour in the name of fair and just administration of justice.
We urge all parties involved to address this issue with the urgency and seriousness it demands, as animal welfare needs to become a priority in our society.
