Travesty Of Justice
Over eight years ago, the NSPCA, under a warrant, found and confiscated a severely maimed and injured monkey in the bedroom of Dr.Elfreda Alberts- a veterinarian.
The female Vervet monkey was observed to be dragging herself around on her remaining forearm as her other limbs had been amputated and she had a deep incision on her abdomen. The NSPCA ensured that the monkey was euthanazed by a veterinarian due to the extent of her injuries.
The NSPCA did not delay in laying charges in terms of the Animals Protection Act No 71 of 1962. Dr Alberts was found guilty on all counts by the Criminal Justice System on 4 March 2020. The sentencing of the veterinarian was handed down on the 25th November 2020.
The NSPCA is deeply troubled by the sentence meted out to the vet. The heinous nature of the crime ought to have been reflected in the sentence to deter others.
The sentencing handed down to Dr. Alberts –
Count 1 – Fined R5000 or three (3) months imprisonment suspended for three years.
Count 2 – Fined R5000 or three (3) months imprisonment suspended for three years.
Count 3 – Fined R750 or thirty (30) days imprisonment suspended for 3 years.
As previously reported, the NSPCA brought this matter to the attention of the South African Veterinary Council (SAVC) who advised us that they would wait for the outcome of the case before taking action. The NSPCA expects the SAVC to finally/urgently take action against Dr Alberts in light of this judgment.
The NSPCA is aware that the accused’s defence have handed in an application to have an acquittal of all charges which will be heard in the Nigel Magistrates Court on 02 December 2020.
The NSPCA feels that justice has not been served in this instance. This monkey was exposed to extreme suffering and abuse at the hands of Dr Alberts.
We sincerely hope that the Nigel Court takes cognisance of the true suffering this innocent soul was exposed to at the hands of a “professional” who was supposed to ensure its welfare was paramount
